1. Acceptance of these Terms

These Terms & Conditions ("Terms") govern the use of the AR-Studio website and the professional Services provided by AR-Studio.

By accessing the Website, making an enquiry, booking a Consultation, purchasing any Service or otherwise engaging AR-Studio, you acknowledge that you have read, understood and agree to be bound by these Terms.

If you do not agree with these Terms, you should not use the Website or engage AR-Studio to provide Services.

2. Services

AR-Studio provides independent professional design services, including but not limited to:

Functional & Ergonomic Design Reviews;
kitchen design services;
wardrobe design services;
bathroom design services;
layout planning;
design consultations;
project assessments;
professional recommendations; and
related advisory services.

Unless expressly agreed in writing, AR-Studio does not provide architectural, engineering, building certification or structural engineering services.

Recommendations are based on the information supplied by the Client and professional judgement at the time the Services are performed.

3. Bookings

Consultations may be booked through the Website or by another method approved by AR-Studio.

A booking is not confirmed until:

payment requirements have been satisfied (where applicable); and
confirmation has been issued by AR-Studio.

AR-Studio reserves the right to decline or cancel a booking where it is unable to provide the requested Services or where exceptional circumstances arise.

4. Fees and Payments

The fees applicable to the Services are those displayed on the Website or otherwise confirmed in writing.

Unless otherwise stated:

all prices are quoted in Australian Dollars (AUD);
payment must be made using the payment methods offered by AR-Studio;
consultation fees must be paid before the scheduled appointment where prepayment is required.

AR-Studio reserves the right to amend its fees at any time. Fee changes do not affect confirmed bookings that have already been paid.

5. Client Responsibilities

The Client agrees to:

provide accurate and complete information;
provide Project Documents where required;
advise AR-Studio of any changes relevant to the project;
attend scheduled Consultations on time;
review recommendations carefully before implementing them;
obtain independent advice where required for structural, engineering or regulatory matters.

The quality of the Services depends on the accuracy and completeness of the information supplied by the Client.

6. Project Information

The Client is responsible for providing complete and accurate Project Documents and all information reasonably required for AR-Studio to perform the Services.

Project Documents may include:

architectural plans;
floor plans;
cabinet layouts;
measurements;
specifications;
photographs;
videos;
sketches;
builder's drawings;
appliance information; and
any other documents relevant to the project.

AR-Studio is entitled to rely on the accuracy of the information provided by the Client and is not responsible for errors, omissions or inaccuracies contained within Project Documents supplied by third parties.

Where incomplete or inaccurate information is provided, the quality or scope of the Services may be affected.

7. Consultations

Consultations may be conducted:

online via Zoom, FaceTime or WhatsApp;
by telephone;
or in person were offered by AR-Studio.

The Client is responsible for ensuring they have suitable internet access, equipment and availability for online Consultations.

Unless otherwise agreed in writing, Consultations are advisory in nature.

AR-Studio does not guarantee that recommendations will be adopted by builders, cabinet makers, architects, designers or other third parties involved in the Client's project.

Recommendations are provided to assist the Client in making informed decisions and do not constitute engineering, structural or building certification advice.

8. Intellectual Property

Unless otherwise agreed in writing, all intellectual property rights in the Services remain the property of AR-Studio.

This includes, without limitation:

reports;
consultation notes;
recommendations;
layouts;
concepts;
written advice;
graphics;
documents;
website content;
branding; and
other materials created by AR-Studio.

Clients may use documents supplied by AR-Studio solely for their own personal project.

No material produced by AR-Studio may be copied, reproduced, distributed, published, modified or used for commercial purposes without prior written consent.

Nothing in these Terms transfers ownership of AR-Studio's intellectual property to the Client.

9. Independent Professional Advice

AR-Studio provides independent professional design advice and recommendations based on the information and Project Documents supplied by the Client.

Unless expressly agreed in writing, AR-Studio does not provide:

architectural services;
structural engineering services;
building certification;
engineering calculations;
construction supervision;
project management;
quantity surveying services;
building inspections; or
legal advice.

The Client acknowledges that AR-Studio's recommendations are advisory in nature and are intended to assist the Client in making informed decisions before construction or renovation work commences.

The Client remains responsible for obtaining all approvals, permits, certifications and specialist advice required for the project.

AR-Studio is not responsible for:

construction methods;
installation work;
measurements taken by third parties;
workmanship;
manufacturing defects;
supplier performance;
builder decisions;
compliance with the National Construction Code, Australian Standards or other statutory requirements;
variations made after the Consultation; or
changes implemented without AR-Studio's further review.

Where recommendations are implemented by third parties, the responsibility for verifying dimensions, technical feasibility, regulatory compliance and construction suitability rests with the relevant contractor or qualified professional.

10. Limitation of Liability

To the maximum extent permitted by law, AR-Studio excludes all liability for any indirect, incidental, consequential, special or economic loss arising from the use of the Website or the Services.

AR-Studio's recommendations are based on the information available at the time of the Consultation and on the accuracy of the information supplied by the Client.

AR-Studio is not responsible for:

construction defects;
workmanship;
installation errors;
manufacturing defects;
supplier performance;
builder decisions;
delays in construction;
changes made after the Consultation
errors in documents prepared by third parties.

Where liability cannot legally be excluded, AR-Studio's liability is limited to the maximum extent permitted under Australian law.

11. Australian Consumer Law

Nothing contained in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where the law permits limitation of liability, AR-Studio's liability is limited, at its discretion, to:

supplying the Services again; or
paying the reasonable cost of having the Services supplied again.

12. Cancellation and Rescheduling

Appointments may be rescheduled where at least 24 hours' notice is provided.

Where less than 24 hours' notice is given, consultation fees are non-refundable unless otherwise required by law.

If AR-Studio is unable to provide the booked Consultation due to circumstances beyond its reasonable control, reasonable efforts will be made to reschedule the appointment.

If rescheduling is not reasonably possible, AR-Studio may, at its discretion, provide an alternative appointment or an appropriate refund.

13. Confidentiality

AR-Studio respects the confidentiality of all information provided by Clients.

Unless required or authorised by law, AR-Studio will not disclose confidential information or Project Documents to third parties without the Client's consent, except where disclosure is reasonably necessary to:

provide the Services;
process payments;
manage bookings;
obtain professional advice;
comply with legal obligations; or
protect the legitimate interests of AR-Studio.

The Client acknowledges that communication by email or other electronic means may involve inherent security risks. While AR-Studio takes reasonable precautions to protect information, absolute security cannot be guaranteed.

14. Website Use

The Website is provided for general information and for the purpose of promoting the Services offered by AR-Studio.

Users agree not to:

use the Website for any unlawful purpose;
interfere with the operation or security of the Website;
introduce viruses, malicious software or harmful code;
attempt to gain unauthorised access to any part of the Website or its systems;
copy, reproduce or distribute Website content without prior written permission.

AR-Studio may suspend, restrict or terminate access to the Website at any time without prior notice where reasonably necessary to protect the Website or its users.

15. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Victoria and any Australian court having jurisdiction to hear an appeal from those courts.

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

16. Amendments

AR-Studio may amend these Terms from time to time.

Any updated version will be published on the Website together with a revised Last Updated date.

The version published on the Website at the time a booking is made will generally apply to that booking unless otherwise required by law.

Continued use of the Website or engagement of AR-Studio's Services following publication of revised Terms constitutes acceptance of those revised Terms.
